In the U.S., there is no requirement for research sponsors to compensate human research subjects who experience injuries as a result of their participation. In this article, we review the moral justifications that compel the establishment of a better research-related injury compensation system. We explore how other countries and certain institutions within the U.S. have adopted various systems of compensation. The existence of these systems demonstrates both that the U.S. lags behind other nations in its protection of human research subjects (...) and that the establishment of a compensation system is both practical and feasible. We then examine factors which have prevented the U.S. from establishing its own compensation system. We consider possible alternatives for the U.S. by examining the advantages and disadvantages of both established and proposed systems. We offer a new proposal that addresses the justice concerns which compel the establishment of a national compensation system, distributes the burdens of such a system on multiple stakeholders that benefit from research, and has the additional advantage of minimizing the administrative and logistical challenges associated with initiating such a system. In a fluent, clear, and lively style this translation by two of Maslov's junior colleagues brings the work of the late Soviet scientist S. Yu. Maslov to a wider audience. Maslov was considered by his peers to be a man of genius who was making fundamental contributions in the fields of automatic theorem proving and computational logic. He published little, and those few papers were regarded as notoriously difficult. This book, however, was written for a broad audience of readers and (...) describes elegant examples of applications in such fields as computer science, artificial intelligence, operations research, economic modeling, and biological modeling, among others. The book also brings to light the work by the American mathematician E. L. Post, which inspired Maslov's own work in the development of a general theory and which has been long neglected by mathematicial logicians and systems theorists in the United States. The book's first chapter introduces the Rules of the Game. Part I, Mathematics of Calculi, covers E. L. Post's canonical systems, deductive systems and algorithms, and probabilistic calculi and deductive information. Part II, Horizonal Modeling, takes up a "toy" economy, the calculi of technological possibilities, and the development of rules. Jardine examines the evolution of concepts of dialectics during the Renaissance and problems of methodology that influenced the teachings of the founder of philosophy in the modern era, F. Bacon. The work traces the sources of these problems in the dialectics of antiquity and its medieval interpretation. Sources little known to the Soviet reader are cited. In order to evaluate Bacon's reaction to the dialectics of his day, the author also describes works named in the statutes of Cambridge University in (...) the sixteenth century as textbooks on dialectics. They are writings by humanists — bearers of the ideas of the Enlightenment — I. Caesarius, R. Agricola, D. Seton, and others. To a certain extent they were based on the work by Peter the Spaniard Summulae Logicales, which is taken as a point of departure for the further evolution of dialectics. (shrink)

This paper exploresTaoistrituals among Iu‐ Mien refugees in the United States and the ways in which Iu‐Mien spirit masters provide means of embodiment for the spirits and gods. The Iu‐Mien practice over two hundred separate rituals to provide healing, pay the spirits for benefits received, purchase good health, life, children, and wealth from the spirits, provide spirit guardians, and assist souls in their transitions through the Iu‐Mien universe. This paper examines the ways in which the gods are embodied during specific (...) rituals in sacred spirit paintings (mienvfang), which in themselves are literal bodies of the gods, complete with bones, flesh, and clothing. In other rituals, the Mien spirit masters themselves embody the gods in trance. The relationship of these embodiments to Iu‐Mien cosmology as well as to communication with the spirit world via divination, ritual, and Chinese literacy is discussed. (shrink)

The article by Academician P. L. Kapitsa published below is devoted to problems of the utmost importance, which have come to be termed "global." The Twenty - fifth Congress of the CPSU pointed to the need to study them scientifically and solve them practically, emphasizing that they touch on the interests of humanity as a whole and will exercise an increasingly marked influence on the lives of every people and on the entire system of international relations. In their social philosophical (...) aspects they have been discussed more than once in the pages of Voprosy filosofii. Discussions of these problems took place at the round tables entitled "Man and His Environment" [See translation in our Fall-Winter 1974 number. — Ed., Soviet Studies in Philosophy], "Social Philosophy Problems of Demography," and "Science and Global Problems of Our Time," and numerous articles have been published in such series as "Science and Social Progress," "The Peace Program and the Dialectics of International Relations" [See translation in our Fall 1975 issue. — Ed., Soviet Studies in Philosophy], and "Man — Society — Nature." The editors of the journal, guided by the directives of the Twenty-fifth Party Congress on the need for further investigation of such global problems of our time, are inclined to continue the discussion of them in the future; another round table devoted to these problems is being planned now. The article by Academician P. L. Kapitsa, it seems to us, will provide fruitful stimuli for discussion at this round table, which will probably be published in several installments. As the author himself emphasizes, certain positions in his article are debatable and require discussion. The journal invites philosophers, demographers, economists, and representatives of the natural sciences to take part in discussions of the problems posed. But even now it is clear that it went far beyond the mere examination of current questions of the ideological and general political work of the party, above all because the speech of the General Secretary of the Central Committee of the CPSU, Comrade Iu. V. Andropov set forth the most important (...) theoretical positions having to do with the preparation of the new version of the program of the CPSU, positions which over the long term will determine the activity of the party and the nation and the development of Soviet society. The importance of the plenum also consisted in the fact that its proceedings brought to light the full scope of the tremendous role played by ideology, by the ideological struggle, and by ideological activity in today's world. There is a struggle going on between two polar opposite world outlooks, two political courses, socialism and imperialism, which is unprecedented throughout the entire postwar period as regards its intensity and ascerbity. There is a struggle taking place for the hearts and minds of billions of people on the planet. The future of mankind depends to no little degree on the outcome of this ideological struggle. Finally, the importance of the Plenum of the Central Committee of the CPSU also lay in the fact that it posed a whole series of extremely important practical tasks in the area of ideological activity, including scientific activity, and the task of intensifying the influence of ideology on solving economic, social, political, and educational problems. I was a doctoral student at IU then and had studied the writings of many of the conference presenters and so the experience of hearing and meeting them in person was a heady one, indeed. I will never forget those impressions of Phil Alperson, (...) Wayne Bowman, Allen Britton, David Elliott, Peter Kivy, Gerard Knieter, Thomas Regelski, Bennett Reimer, John Shepherd, Ann Stokes, Eleanor Stubley, Keith Swanwick, and many others.I was interested in meeting Michael after hearing his response to the presentation of one of my favorite IU professors of musicology, Austin Caswell. Caswell’s provocative paper, “How We Got into Canonicity and What it has Done to Us: An American Music Historian’s View of Music in Academia,” claimed that “the effect of canonicity on American musical life is destructive,” while Michael’s response was characterized by his style of writing that I came to recognize over the decades as distinct, calm, logical, methodical, and based in an extraordinarily wide and deep wealth of historical knowledge. While I greatly admired my rebellious and passionate professor’s views and temperament which were not unlike my own, I also appreciated hearing Michael’s measured and thoughtful response. Thus began my friendship with Michael, who, I learned, was not only a professor [End Page 92] and dean at Towson State University but also an avid big band woodwind doubler who showed interest in my doctoral research in the art of vocal jazz improvisation. That friendship lasted for almost twenty-eight years and we enjoyed memorable reunions at other conferences. For example, there was the ISPME conference held at UCLA where he invited me to dinner with his good friend and connoisseur of fine wines, Bennett Reimer, and the ISPME conference in Helsinki where, after I tripped and severely broke my ankle, requiring surgery, Michael, Estelle Jorgensen, Iris Yob, and two then-doctoral students (Kasia Bugaj and Leonard Tan) visited me in the Helsinki hospital.When I began teaching at the University of Southern California in 1995, it was fortuitous that Michael’s brother, Brian, lived in the Los Angeles area. His frequent visits allowed him to make several guest lectures to my graduate research methods classes, very welcome opportunities. After one of those lectures, I relayed the history of my family’s ballroom in the Chicago area that was open for business with big band music from 1929 until 1967. He asked if I had any artifacts from Madura’s Danceland, and when I mentioned my father’s stacks of dusty record books, newsletters, photos, and posters in our basement, he became very enthusiastic and told me that I had a “gold mine” of an archive with which to write a book about the place! As a trained quantitative researcher, I began to explore the record books to analyze trends in band pay over the Depression and World War II years.1 Over the next ten years, with help from Michael’s regular prodding and encouragement, I organized the large archive into the history of Madura’s Danceland.2 I owe this personally important accomplishment to Michael Mark.Michael invited me (in his endearing way which I could not refuse) to coauthor a music education textbook with him3 and our writing partnership went so smoothly that he invited me to co-author the 4th edition of his Contemporary Music Education.4 Although our writing styles and areas of expertise were very different, I learned much from his narrative approach which included illustrative scenarios, interviews, and the informal use of contractions, a style of writing that was not second nature for me. To study the L shi chunqiu (or L -shih ch'un-ch'iu. Master L 's Spring and Autumn Annals is to enter into the tumultuous but progressive times of the Warring States period (403-221 BCE). 1 This period is commonly referred to as 'the pre-Qin period' because of the fundamental changes that occurred after the Qin unification. Liishi chunqiu was probably completed, in 241 BCE, by various scholars at the estate of L Buwei (L Pu-wei) the prime minister of Qin and tutor (...) to the Qin child King, Zheng. 2 It is one of the few pre-Qin texts that dates itself; the date, though not precise, is given in the xuyi chapter. 3 A decade after the completion of the L shi chunqiu, King Zheng began the ensuing 9 years of fervent warfare that led to his unification of the empire in 221 BCE. Before the political unification, L shi chunqiu created a philosophical consolidation. 4 The Liishi chunqiu performed an important function in the literary and political education of the young King Zheng. More importantly, it provided a philosophical understanding of and justification for a unified empire which left its mark on the young King, and subsequent Han philosophy. After the unification of the empire, King Zheng took the title Qin shihuangdi (First-generation Emperor of Qin), and he established the insignia of water for the imperial emblems, employing concepts from Liishi chunqiu's yingtong (responding and identifying) chapter which describe the succession of dynasties according to the timely cycle of the five phases (wuxing) to justify his new dynasty. 5. Leiseringo ir R. Walkerio (1998) pasiūlyta „gyvenimo eigos politikos“ analizės schema. Analizė rodo, kad Lietuva iš savo autoritarinės praeities paveldėjo stiprius gyvenimo eigos struktūravimo, integracijos ir normų formavimo mechanizmus. Vis dėlto šie mechanizmai silpsta arba yra adaptuojami prie šiuolaikinio socialinio, ekonominio ir politinio konteksto. Dėl to šiuolaikinę Lietuvą galima priskirti pofordistiniam gyvenimo (...) eigos režimui, kuris pasižymi gyvenimo eigos destandartizacija, depolitizacija ir didesniu socialinės politikos institucijų lankstumu. Perėjimas prie šio gyvenimo eigos režimo mūsų šalyje įvyko vėliau, palyginti su kitomis Vakarų Europos šalimis. Ukrainian science and its terminology in the nineteenth century experienced a number of twists and turns. Divided between two empires, it lacked institutions, scholars pursuing it, and a unified literary language. One could even say that until the late nineteenth century there was a possibility for two communities with two literary languages to emerge – Ruthenian (Habsburg Empire) and Ukrainian (Russian Empire). Eventually, both communities and languages merged. This article tracks the meanderings of this process, arguing that scholarly publications played (...) a crucial role in shaping the standard for the scientific language. The article follows the biography of the naturalist Ivan Verhrats’kyi (1846–1919), the author of the first dictionaries of naturalist terminology in Ruthenian in 1860, a translator and author of textbooks, and the head of the Mathematical–Naturalist–Medical Section of the Shevchenko Society in L’viv. He thus shaped many Ruthenian, and then Ruthenian–Ukrainian scholarly projects. Initially successful with his approach to making the Ruthenian scientific language vernacular, in the 1890s his approach was losing ground to the internationalization of vocabulary and to the growing pressure toward the unification of Ruthenian and Ukrainian. Finally, in the beginning of the twentieth century, Verhrats’kyi became marginalized within the Ukrainian scholarly community. By discussing the history of a minority language within imperial structures, I argue that the media in which scholarly work was published requires special attention. In the Ruthenin–Ukrainian case, they determined the standard for scientific language. Lacking professional journals, Ruthenian scholars published in the 1860s–late 1880s in popular newspapers and in school textbooks, requiring them to use a language that was near to the spoken tongue of the Habsburg province. Once the political situation changed, favoring Ruthenian–Ukrainian unification, and scholarly journals appeared and transgressed the imperial boundary, the favored language had to be transimperial, ousting out the vernacular. Critics of contemporary metaphysics argue that it attempts to do the hard work of science from the ease of the armchair. Physics, not metaphysics, tells us about the fundamental facts of the world, and empirical psychology is best placed to reveal the content of our concepts about the world. Exploring and understanding the world through metaphysical reflection is obsolete. In this paper, I will show why this critique of metaphysics fails, arguing that metaphysical methods used to make claims about the (...) world are similar to scientific methods used to make claims about the world, but that the subjects of metaphysics are not the subjects of science. Those who argue that metaphysics uses a problematic methodology to make claims about subjects better covered by natural science get the situation exactly the wrong way around: metaphysics has a distinctive subject matter, not a distinctive methodology. The questions metaphysicians address are different from those of scientists, but the methods employed to develop and select theories are similar. In the first section of the paper, I will describe the sort of subject matter that metaphysics tends to engage with. In the second section of the paper, I will show how metaphysical theories are classes of models and discuss the roles of experience, common sense and thought experiments in the construction and evaluation of such models. Finally, in the last section I will discuss the way these methodological points help us to understand the metaphysical project. Getting the right account of the metaphysical method allows us to better understand the relationship between science and metaphysics, to explain why doing metaphysics successfully involves having a range of different theories, to understand the role of thought experiments involving fictional worlds, and to situate metaphysical realism in a scientifically realist context. Hypothalamic and ovarian GnRH mRNA and pituitary LH~ mRNA levels were determined by respective RNA-blot hybridizations, and ovarian GnRH and estradiol contents and serum LH levels were measured by respective radioimmunoassays. Three animal models such as 1) PMSG-treated, 2) PMSG and heG-treated immature rats and 3) proestrous stage of adult rats were used. Immature rats (25-days old) were administered with PMSG (10 iu) at 10:00 hand 48 h later with heG (10 iu) to induce ovulation. In the PMSG-injected model, hypothalamic GnRH mRNA levels were markedly augmented about 9-fold at 50 h, and pituitary LH mRNA 3-fold at 52 h after PMSG administration. Serum LH levels were increased to the preovulatory surge levels at 56 h, and ovarian GnRH mRNA levels were augmented 4-fold at 60 h after PMSG injection. Administration of heG also induced a marked enhancement in ovarian GnRH mRNA levels in comparison to the values shown in both intact and PMSGtreated rats at 52 hand 54 h, respectively. In the proestrous stage of normal adult rats, pituitary LH~ mRNA levels were peaked at 16:00 h. The preovulatory LH surge was evident at 4 h before increment in ovarian GnRH mRNA levels as shown in PMSG-treated rats. The present study clearly showed the sequential increase in hypothalamic GnRH mRNA, pituitary LH~ mRNA and ovarian GnRH mRNA levels, indicating that ovarian GnRH may play a possible role in the control of follicular maturation and the ovulation process. In today's conditions, the heavy resistance of Ukrainians to Russian aggression, which is carried out, with the exception of the military, by way of information and economic methods, and now also through a non-gossip "hybrid" confrontation, it is very important to properly evaluate and play an appropriate role in this religious and religious factor. "Russian World" is no less effective weapon of the Moscow Church in the war with Ukraine than the military aid of the Russian state to the separatists.. (...) Religious communities have their potential in educating citizens - patriots of their homeland, or else. Different aspects of the problem of the role of religious-church factors in patriotic education of Ukrainians have long been in the zone of justified attention of domestic secular scholars and representatives of the Churches, among them: A. Kolodny, L. Filippovich, V. Shevchenko, P. Pavlenko, O. Sagan, C. Zdioruk, M. Cherenkov, O. Tuyeshin and others. Particular attention of the RCC and Protestant Churches in this regard was given by P. Instead, the failings of the three sages are skew to each other. Boyi lacks righteousness; Y i Yin lacks benevolence; and L iu Xiahui lacks wisdom. The comparison of the sages centers on the question of when to resign an advisory position. According to Mencius, one should resign only if one’s advice will not be heeded, or if (...) declining to resign would somehow lead to wrongdoing. Associating with wrongdoers and benefiting from the wrongdoing of others might lead to wrongdoing. Wrong motives might distort one’s advice. Insults from the advisee might be evidence of the futility of giving advice. Legal decision-support systems have the potential to improve access to justice, administrative efficiency, and judicial consistency, but broad adoption of such systems is contingent on development of technologies with low knowledge-engineering, validation, and maintenance costs. This paper describes two approaches to an important form of legal decision support—explainable outcome prediction—that obviate both annotation of an entire decision corpus and manual processing of new cases. The first approach, which uses an attention network for prediction and attention weights to highlight salient case (...) text, was shown to be capable of predicting decisions, but attention-weight-based text highlighting did not demonstrably improve human decision speed or accuracy in an evaluation with 61 human subjects. The second approach, termed semi-supervised case annotation for legal explanations, exploits structural and semantic regularities in case corpora to identify textual patterns that have both predictable relationships to case decisions and explanatory value. „Posocializmas“, „pokomunizmas“, „transformacija“ ir kiti semantiškai susiję žodžiai turi laikinumo atspalvį. Akademikai ir politikos formuotojai suvokė, kad šis laikotarpis bus sunkus eiliniams gyventojams. Svarstoma, kad Lietuvoje transformacijos laikotar­pis baigėsi – pavyzdžiui, 2004 m., šaliai įstojus į ES ir NATO. Tačiau nežinome, kada šis laikotarpis pasibaigė žiūrint iš Lietuvos gyventojų perspektyvos (jeigu apskritai pa­sibaigė). Todėl šiame straipsnyje siekiama atsakyti į klausimą, kokie su transformacija susiję periodai arba lūžiai išryškėja (jeigu išryškėja) socialinėje atmintyje. Straipsnyje laikomasi periodo definicijos, pagal kurią jis turi ribas (...) laike ir pavadinimą, suvokiamas kaip homogeniškas. Kokybiniai interviu, 2021 m. vasarą surinkti Panevėžyje, Jonavo­je ir kaimuose aplink šiuos miestus, analizuojami taikant refleksyviąją teminę analizę (RTA). Daroma išvada, kad transformacija yra glaudžiai įsipynusi į dabartinį Nepri­klausomybės laikotarpį. Viena vertus, kai kurie tyrimo dalyviai pasakojo apie „per­ versmo“, „suirutės“ laiką, kartais jį lygino su pokariu. Kita vertus, atmintyje kur kas ryškesnis bendras atkurtos Nepriklausomybės laikotarpis: jis suvokiamas kaip daug­maž homogeniškas laipsniškos kaitos laikas, kurį įmanu palyginti su stambiu periodu prieš esminį lūžį – sovietmečiu. The figure of Peter the Tomb, various aspects of his life and activity, as well as the era called by his name, have long been the subject of study by numerous scholars, comprehensive and meticulous research. It is enough to mention the works of M.Grushevsky, A.Zhukovsky, V.Klimov, A.Kolodny, V.Nichik, O.Sarapin, L.Filipovich and V.Shevchenko, in which the phenomenon of the metropolitan, his spiritual and religious dominant, is thoroughly and thoroughly explained, the influence of P. Mogila's heritage on the past and (...) present. And yet it is impossible to talk about the exhaustiveness of this topic, because such inexhaustibility is dictated by the very universe of its multidimensional activity. This is what determines the relevance of the proposed article. And this, in turn, gives rise to reflections on the need for scientific innovative understanding of religious philosophy as a constant basis of thinking of Petro Mohyla, which, in particular, was reflected in his "Notebook", which is still a little-studied phenomenon of Ukrainian spiritual culture, for the first time it saw the world only in 1995, more than 60 years after its invention by M. Grushevsky. This work, like all narratives on the spiritual and religious themes that make up it, is an integral part of the metropolitan's religious and philosophical heritage. (shrink)

Straipsnyje, remiantis pusiau struktūruotų biografinių interviu duomenimis, nagrinėjama lietuvių diasporos Kazachstane antrosios ir trečiosios kartų atmintis ir jos naudojimas jų etninės tapatybės daryboje. Po sovietmečiu nutrūkusio atminties perdavimo iš kartos į kartą ši atmintis daugiausia atkuriama kaip šeimų atmintis ir dėl vyraujančios „paveldimos“ etninės tapatybės sampratos jos atkūrimas vyko ir vyksta drauge su lietuviškosios tapatybės atkūrimu. Šeimų atminties atkūrimo emociniai poreikiai palikuonių kartose sustiprina ir etninės tapatybės atkūrimo poreikį, kai kuriais atvejais ši atmintis tampa svarbiu jos ištekliu.

This paper continues a discussion concerning the distinction between disability and handicap initiated in this volume by Steven D. Edwards. Edwards argues that the reasons advanced by the WHO for this distinction in its International Classification of Impairments, Disabilities and Handicaps (ICIDH) are not valid. Edwards also criticizes my own quite different grounds for distinguishing between the two concepts. His general conclusion is that the distinction is superfluous. In this paper I claim that Edwards's reasoning is invalid. I present five (...) arguments for my case, viz., the arguments from: a) practical necessity, b) cost-effectiveness, c) clinical practice, d) the subject's vital goals, and e) the universal presence of some basic action. My own conclusion thus is that there is a need within health care for a distinction between disabilities and handicaps. I also indicate that there may be a need for further distinctions along the dimension of action-generation which is presented in the paper. (shrink)

We critically revisit the definition of thermal equilibrium, in its operational formulation, provided by standard thermodynamics. We show that it refers to experimental conditions which break the covariance of the theory at a fundamental level and that, therefore, it cannot be applied to the case of moving bodies. We propose an extension of this definition which is manifestly covariant and can be applied to the study of isolated systems in special relativity. The zeroth law of thermodynamics is, then, proven to (...) establish an equivalence relation among bodies which have not only the same temperature, but also the same center of mass four-velocity. At the turn of the century, Gottlob Frege and Edmund Husserl both participated in the discussion concerning the foundations of logic and mathematics. Since the 1960s, comparisons have been made between Frege's semantic views and Husserl's theory of intentional acts. In quite recent years, new approaches to the two philosophers' views have appeared. This collection of articles opens with the first English translation of Dagfinn Føllesdal's early classic on Husserl and Frege of 1958. The book brings together a number of (...) new contributions by well-known authors and gives a survey of recent developments in the field. It shows that Husserl's thought is coming to occupy a central role in the philosophy of logic and mathematics, as well as in the philosophy of mind and cognitive science.
